A week later. Phone rings. It’s Tammy, mom of little Leo who was laughing hysterically in one of my favorite pics. Her voice? Ice cold.
“Take Leo’s photo down. NOW.”
My stomach just dropped. She wasn’t asking, she was commanding. Apparently Leo’s dad? Involved in some messy court case, zero pictures of the kid were allowed online for safety. Who knew? Not me.
Deleted everything instantly, felt like a total jerk. Apologized like crazy. But the damage was done. Trust gone.
Time For Homework (The Boring Kind)
Okay. Clearly needed a system. Couldn’t just snap and post. Started digging into the whole consent nightmare.
Here’s what really matters:
- Permission is NOT implied. Just because someone shows up at an event I’m shooting? Doesn’t mean squat.
- Kids = Double Trouble. You absolutely need the parent or guardian to say yes. Written proof! Verbal ain’t worth the paper it’s printed on if things go sour.
- Money Makes it Weird. Selling prints or using the pic commercially? That’s a whole other circus. Need way more specific permission for that stuff.
- Europe Plays Hardball. Ever hear of GDPR? Basically Europe’s rulebook makes this even tighter.
- Consent Can Expire. Just cause they said yes last year doesn’t fly this year. Gotta check if the form actually says forever, or needs renewing.
Building My Bulletproof Shield
Dove headfirst into templates. Looked at dozens online. Most were either legalese nightmares costing serious cash, or super flimsy freebies missing key parts.
Ended up taking bits and pieces. Made my own basic form. Here’s the core of it:
- Clear WHO: Name of the person (or parent/guardian for kids).
- Plain English WHAT: Exactly what photos I’m using (“Images taken at the Smith Family BBQ, June 1st”) and how they might be used (“Posting on my personal blog about parenting experiences”).
- The Big MONEY Clause: Specific checkbox asking if they’re cool with commercial use. Separated this clearly!
- Contact Info Swap: They sign, I give them my email in case they ever change their mind.
Printed a bunch. Stuck ’em on a clipboard with a few pens. Every time I shoot something now where people are recognisable?
Clipboard comes out.
Explain it quick and friendly: “Hey folks, just want to be super respectful about your privacy! Need a quick tick here if you’re okay with possibly ending up on the blog? Takes two seconds!”
The Aftermath & Why It’s Worth the Hassle
Honestly? It felt awkward at first. Like maybe I was being too formal with friends. But zero complaints so far.
People actually appreciate being asked. Feels respectful. Saved my butt multiple times already. Recently shot a local craft fair – some vendors actually thanked me for being so organised.
Is it annoying paperwork? Absolutely. Still find myself groaning internally.
But compared to that cold sweat panic after Tammy’s call? Knowing everyone documented is consenting? Pure peace of mind. No more 3 AM sweats.
